Terms & Conditions
Welcome to Harbourne Products Limited, the thebeauty.biz website Terms and Conditions for use. These Terms and Conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the Terms and Conditions set out below. If you do not agree to be bound by these Terms and Conditions you should not use or access this Website. Registering and Registered Users
Harbourne Products Limited requires that members leave a valid business name and address, contact name and postcode. These are used to better serve the users.
- You will leave valid contact information to be used only by Harbourne Products Limited for purposes of regular contact and tracing problems.
- The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and
- You will notify us immediately of any changes to the Personal Information by contacting our Customer Service Department by e-mail info@thebeauty.biz or call us on 01372 729629 between 9am-4.30pm Monday to Friday.
- You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
Statutory Rights.
We are a UK based company, subject to UK consumer law. None of the information detailed in our Terms and Conditions affects your statutory rights as a consumer. We may not be able to accept your order, or part of your order, prior to despatch due to the following reasons:
• Authorisation of your payment failed. • We made a pricing or product description error. • Any other reasonable cause unforeseen at the time the order was placed. • You not meeting the eligibility to order criteria set out in the Terms and Conditions. • You live outside the United Kingdom
If there are any problems with an order, you will be contacted by one of our Customer Service team by email or telephone. If payment has been taken we will credit your account with any sum deducted by us as soon as possible, but no later than 30 days from the date you placed your order.
Making An Online Purchase.
Making a purchase couldn't be easier, just add products to your basket. Select the product you want, click on ‘add to basket’. After you have finished making your selection, progress through the screens following the instructions carefully, you will be asked for your delivery address details; at this point you can choose to send it to an alternative address, We try to ensure that all products on the website are in stock. If a product is very popular and we do run out we will mark it ‘out of stock’. Ordering errors.
You are able to correct errors on your order up to the point at which you click on ‘checkout’ on the final page of our ordering process.
Acknowledgement and acceptance of your order.
We will notify you by email as soon as possible to confirm receipt of your order and then with details confirming delivery of your purchase. We will notify you if the product is not available due to some unforeseen circumstance.
Delivery Schedule.
Deliveries can only be made within the UK and Channel Islands. Not all of our delivery options are available to all areas of the UK and Channel Islands. We will deliver in accordance with the delivery option selected by you. Please view our Delivery Options for full details. There will be an additional surcharge for deliveries to Eire, Channel Islands, Isle of Man and Scottish Highlands if applicable.
We aim to deliver your order as quickly as possible and will normally send your order within 3 business days but at certain busy times of the year, such as Christmas, this may be up to 5 working days.
PLEASE NOTE THAT WE ONLY DELIVER TO UK ADDRESSES
If you wish to purchase Pier Auge products from abroad, please contact us using sales@thebeauty.biz and we will endeavour to supply you with the details of your local distributor. Alternatively email Pier Auge France directly using info@pierauge.com and they will be more than pleased to assist you.
Back Orders.
If a product is subsequently out of stock, we will notify you and mark the product(s) as BACK ORDER and these will be sent, post free, as soon as available. If you do not wish to have BACK ORDERS, please advise us.
VAT
Our prices are stated in Pounds Sterling (£) and include Sales Tax (VAT) at the rate of 17.5%, unless you are a Registered Trade User in which case the prices quoted are ex VAT.
Credit Card Security.
All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.
Payment
• Any returned or cancelled cheques will incur a charge of £7.50 + VAT • Payment by personal or business credit card carries an administration charge of 2% • Settlement strictly 30 days net from invoice date for trade account customers only • Goods are not sold on a “Sale or Return” basis
Events beyond our Control.
Harbourne Products Ltd shall have no liability to you for failure to deliver goods, delay in delivery, damage to or defect in goods delivered caused by events or circumstances beyond our reasonable control; including, but not limited to, industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident, acts of terrorism or war.
Liability.
We shall have no liability to pay any money to you by way of compensation. Harbourne Products Ltd shall have no liability for products delivered which prove to be different from what you ordered, are damaged or defective, or the quantity is incorrect, unless you notify us of the problem via email within 7 working days of the delivery.
If you do not receive products ordered within 30 days of the order date, we shall have no liability to you unless you notify us of the problem via email in writing within 40 working days of the expected delivery date. We will also be tracking your delivery with our courier service if used.
If you notify us of a problem our only obligation will be to make good any shortage or non-delivery, to replace or repair any goods that are damaged or defective, or to refund the amount paid for the goods.
Save as precluded by law, we will not be liable for any direct, indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill), howsoever arising, out of any problem you notify to us under this condition.
Data Protection
When you provide us with information it may be used for the following purposes:
• Processing your orders and customer service; • For statistical or survey purposes to improve this Website and its services to you; • To administer this website; • For the prevention and detection of fraud; • If you consent, to notify you of products or special offers that may be of interest to you.
Personal information that we hold will be held securely in accordance with the law and the 1998 UK Data Protection Act. We will never collect sensitive information about you without your consent. We endeavour to ensure the information that we hold will be accurate and up to date. If you want a copy of the information, you can log onto your user profile and view it. If you notify us of any inaccuracies we will correct the errors promptly, or alternatively please logon and make the change yourself.
We will not supply any of your details to any third party, save our financiers Venture Finance plc for the purpose of obtaining sales ledger finance, in the future except for the purposes of debt recovery, unless required by law. The information we collect about you includes: your name, address, telephone number, email address, products ordered, your credit/debit card details.
Remittance Terms.
Products remain the property of Harbourne Products Ltd until paid for.
